These Terms of Service (the "Terms") govern use of the mobile application ClipBlend (the "App"), created and made available by Sławomir Toporek, an independent developer of the ClipBlend Android application (the "Developer"). By using the App, you accept these Terms.
1. Definitions
App — the ClipBlend mobile application for Android, distributed via Google Play.
Developer — Sławomir Toporek, an independent software developer (individual), author and publisher of the App.
User — a natural person using the App.
Account — the User's account registered via Firebase Authentication using an email address and password or Google Sign-In (Continue with Google; the same OAuth flow is used for sign-in and registration).
YouTube Services — App features based on YouTube Data API v3.
YouTube Charts — curated regional/global chart playlists (metadata from YouTube; cached on the Developer's backend for all users).
App navigation: The main tabs are labeled My Videos, Liked, Playlists, Charts, and Create; account-related options and legal documents are under Account (open via the account icon, top right).
2. Description of the service
The App allows Users to:
View and browse liked videos from YouTube (synchronization and local organization on the device);
View videos uploaded to their own YouTube channel;
Browse playlists synced from YouTube (list, details, and video metadata);
Organize videos locally in the playlist editor in the Create tab (e.g. reordering on the device);
Browse YouTube Charts — lists derived from official YouTube Charts playlists; metadata may be refreshed on a schedule via the Developer's servers and stored in Firebase; video playback opens in the YouTube app or browser.
In the current version, the App uses read-only YouTube API access (youtube.readonly OAuth scope): it synchronizes and displays your library but does not create, edit, or delete playlists or other content on your YouTube channel. The App acts as a client for YouTube Data API v3 and does not host or store video files. Chart lists are aggregated metadata only (not your private account data).
3. Conditions of use
3.1. Requirements
The User must be at least 16 years old (or have parental/guardian consent where required).
YouTube features require a Google account and OAuth permissions.
The App requires an active internet connection for YouTube synchronization and other core online features. Without connectivity, synchronization and related functions do not work.
Library synchronization may download video metadata and thumbnails and may use mobile (cellular) data depending on your connection. You can allow or disallow cellular sync in Account → Allow Mobile Data Sync.
The interactive video list in the Charts tab and the playlist video list in the Create tab require prior YouTube (Google) sign-in in the App.
The User agrees to use the App in compliance with applicable law, these Terms, and Google and YouTube service terms.
3.2. User account
Sign-in to the App uses Firebase Authentication: you may register or sign in with an email address and password (at least eight characters, including at least one letter and one number). Alternatively you may use Continue with Google (Google OAuth for sign-in and registration). Accessing YouTube-related features may additionally require separate Google OAuth consent for the YouTube Data API.
The User is responsible for the confidentiality of their credentials and their Google account security.
The User may log out of the App or YouTube at any time in the Account section.
Logging out ends the session and removes OAuth tokens from the App; local cache on the device may remain until you clear the App's data in Android system settings or uninstall the App — see the Privacy Policy.
3.3. Prohibited conduct
The User agrees not to:
Use the App in a way that violates YouTube or Google terms;
Reverse engineer, decompile, or modify the App;
Use the App unlawfully, including infringing copyright;
Automate interactions with the App beyond normal personal use;
The App does not store video files — only metadata (titles, thumbnails, video IDs) from the YouTube API.
If a future App version enables write access to your YouTube channel, it will request a broader OAuth scope and your renewed consent before doing so.
YouTube API limitations
The App uses YouTube API Services and does not store or use user data in a way that violates the Google API Services User Data Policy.
5. Advertising
The App shows ads via Google AdMob (banners, full-screen ads, rewarded ads).
Rewarded ads are optional and never block core functionality.
You may watch a rewarded ad to enable temporary ad-free mode.
For users in the EU/EEA, personalised ads require prior consent under applicable data protection law.
6. Intellectual property
The App, its source code, UI, graphics, and icons are owned by the Developer and protected by copyright.
Videos, thumbnails, and metadata shown in the App belong to their respective owners and are provided via the YouTube API.
YouTube, Google, and related marks belong to Google LLC.
The User acquires no IP rights in the App beyond the right to use it under these Terms.
7. Limitation of liability
The App is provided "as is", without warranties, except where mandatory law provides otherwise. These provisions do not exclude or limit liability towards consumers where such liability arises from mandatory statutory provisions (including EU consumer law).
The Developer is not liable for:
Unavailability or changes to YouTube Data API or Google services;
Data loss due to User actions (e.g. log-out, uninstallation);
Video content displayed via the YouTube API or Charts feature (content belongs to right holders on YouTube);
Damage from use of the App contrary to these Terms.
Nothing above limits liability that cannot be limited under mandatory law (including EU consumer law).
8. Availability
The Developer aims to keep the App working but does not guarantee uninterrupted availability.
The Developer may suspend the App temporarily for maintenance, updates, or technical reasons.
The Developer may stop providing the service with reasonable notice.
9. Privacy
Personal data processing — including authentication, YouTube access, advertising, usage analytics (Google Analytics for Firebase (GA4)), and crash reporting (Firebase Crashlytics, when consent allows) as further described in the Privacy Policy — is governed by our Privacy Policy, which forms part of these Terms. The Privacy Policy is available in the App (Account) and at the URL provided in the Google Play listing.
Where processing is based on consent (e.g. personalised ads, analytics in the EEA), you may withdraw consent at any time via the App's consent settings or your device settings without affecting the lawfulness of prior processing.
10. Changes to the Terms
The Developer may change these Terms.
Material changes will be communicated via an app update or in-app notice.
Continued use after changes constitutes acceptance.
If you do not agree, stop using the App and uninstall it.
Disputes should first be resolved amicably; failing that, competent courts apply.
12. Final provisions
If any provision is invalid, the remainder stays in effect.
Failure to enforce a right is not a waiver.
These Terms take effect when published.
13. About the Developer
The App is created and maintained by Sławomir Toporek, an independent software developer resident in the Republic of Poland. The Developer has no NIP, REGON, or business seat. The App is an individual project.
